34 year old Polish national Kamil Szymczak, with an address in Fermoy, appeared before Mallow District Court charged with sexually assaulting the teenage girl at Chapel Hill in Fermoy on Monday February 7th last just after 1pm.
Detective Garda David Forsythe gave evidence of arrest charge and caution and said the accused made no reply when the charge was put to him. Detective Forsythe also said there was strong evidence against the accused.
Sergeant Linda O'Leary said Gardaí had serious objections to bail.
Defence solicitor Ciaran O'Keffee said his client is receiving psychiatric and medical care for a dependence on drugs and alcohol and asked detective Garda Forsythe if he would describe that his client had made a stupid mistake and that the allegation was at the lower end of the scale. Garda Forsythe said he couldn’t comment.
Judge Alec Gabbett said that he didn’t see how anyone could say that the alleged offence wasn’t serious and remanded the accused in custody to appear in court again via video link on the 15th of this month
