Karen Harrington (38) of Lakelands Crescent in Mahon in Cork is on trial at a Central Criminal Court sitting in the city, charged with the murder of Santina Cawley at 26 Elderwood Park in Boreenmanna Road on July 5th, 2019.
Senior Counsel Sean Gillane said Harrington had offered a 'doughnut shaped' account of what had happened, claiming there was a massive hole in the middle in relation to the hours in which Santina sustained the injuries that led to her death.
He also told the jury that there was no evidence that Michael Cawley caused any injuries to his daughter.
Senior defence Counsel Brendan Grehan said it was his client's consistent position that she did not cause Santina Cawley's injuries.
He suggested it was a case where the jury should be left with a doubt and called on the jury to find his client not guilty.
Mr Justice Michael McGrath has commenced his charge to the jury and told them they need to approach the evidence in a "clinical and dispassionate" manner
He described the presumption of innocence as being the bedrock of our jurisprudence and said the burden of proof is at all times on the Prosecution.
The charging of the jury continues tomorrow.
