Enoch Burke will have to wait to find out if his appeal against court orders, including an injunction to stay away from his former school, has been successful

The judges of the Court of Appeal decided to reserve their judgement but said they wouldn’t delay in delivering their ruling.

After indicating he wouldn’t comply with the orders while his appeal is before the court, the judge decided to limit Enoch Burke’s appeal today.

When it eventually got underway, Enoch took aim at the decisions of two High Court judges that led to him being hit with injunctions to stay away from the school.

He accused one of the judges of failing to properly apply the required “fair question test.” In failing to do so, he claimed the orders were unlawful and therefore invalid.

Lawyers for the school disagreed.

Enoch Burke also claimed he was wrongly suspended from teaching duties because of his religious beliefs. The school’s barrister, Mark Connaughton SC, said it was his behaviour in light of a request to address a transitioning student by a new name and gender-neutral pronoun that led to Stage 4 of a disciplinary process being engaged.

Judgement was reserved today but Mr Justice George Birmingham acknowledged the great importance of the case to those involved and said they wouldn’t delay in delivering their ruling.
