A second file will now be prepared for the Director of Public Prosecutions after another man was also released without charge.
43-year-old Thomas Dooley and his wife were at a funeral in Rath Cemetery in Tralee last Wednesday morning when they were attacked.

She was rushed into emergency surgery at Kerry University Hospital, which is just 500 metres from the Cemetery gates.
Two men have since appeared in court, charged with Thomas Dooley's murder, and were remanded in continuing custody at an appearance in Tralee this Wednesday gone.
Two more men were also arrested, but both have been released without charge and files are being prepared for the DPP.
Thomas Dooley was laid to rest yesterday in Tullamore, his coffin covered in a Kerry GAA flag.
At mass earlier in the day, parish priest Father Joseph Gallagher recognised it was a 'very difficult time' for the family.
The two men who have been charged with Thomas Dooley's murder will appear again in court on October 26th.
