The ruling relates to a phone data ruling which could help Graham Dwyer in his fight to overturn his conviction for the murder of Elaine O'Hara
The Bandon architect was jailed for life after he was convicted of the murder of the 36 year old childcare worker whose remains were found in the Dublin Mountains.
The State says the High Court ruling has implications extending beyond Dwyer's case and could have an adverse impact on the investigation and prosecution of serious crime.
The appeal was heard last December and judgement was reserved.
The Echo reports that judgement will now be given on Monday during the Supreme Court's first ever sitting in Waterford.
