The second day of Graham Dwyer’s murder appeal gets underway shortly.
The 50 year old was found guilty of murdering childcare worker Elaine O’Hara in 2015 but Mr. Dwyer claims he was denied his right to a fair trial.
Graham Dwyer is attempting to overturn his murder conviction, with his main ground of appeal being the admissibility of mobile phone evidence in his trial.
The law which allowed investigators to access data on his devices have since been declared unlawful by the EU’s Court of Appeal and Dwyers team argue it shouldn't’ have been included in the first place.
They also claim the judge prejudiced the jury during the trial, when she gave Mr. Dwyer a disapproving look.
Later, the prosecution will put forward their arguments in defence of the trial.
A decision on the appeal is not expected today.
