Fingal County Council is being urged to challenge a High Court decision on night-time flights at Dublin airport.

Last night a judicial review was granted to the daa to challenge an order cutting the number of flights between the hours of 11pm and 7am to just 65.

The council had found the airport's operator was in breach of planning permission and gave it six weeks to comply.

The judicial review won't be heard until November, and the court issued a stay until then meaning the flight schedule can remain unchanged.

David Walton from the Ballyboughal Community Council, says residents are 'gutted'.

"They've put a very strong spin on this, and the judge seems to have gone for it.

"I think Fingal have 48 hours to fight it, I hope that they put their full resources behind it because this is the integrity of the planning system which is at stake.

"I think people will be gutted if this decision goes ahead."
